Terms and Conditions
Our current terms and conditions are as
follows. All are subject to change and apply to all AIP customers.
These terms and conditions constitute the entire agreement between
AIP and its customers. These terms and conditions depose all prior
agreements whether verbal or in writing.
AIP will register a domain name, design the site and update it as
per the individual package put together for the above client.
A domain name will be registered in the client's name and it is the
client who will own the domain name.
The above named client also authorises 1st Choice Promotions to
handle the promotion of the web site on search engines unless I
choose to engage another company to do this for me.
CONTENT
The client is at all times responsible for the content of the site,
including both text and images. If changes are required then
reasonable notice must be given to Associate Internet Promotions for
the updates to be made. Most updates will be done by AIP within 1—2
days of receipt, normally sooner. Sufficient notice will be given if
a substantial update or addition is required.
COSTS
The cost of the web site project will be as laid out for the
individual quote provided. If extra updates are required, the cost
will be £15 per hour, minimum £5 and additional pages will cost
£2.50 each for the first 5 and then £5 each after that. Typing of
text from paper format into your web site is included in the cost of
the package, although it is preferred to be able to copy straight
from a file provided in electronic format or by e-mail.
Any other additional work required will be charged at a cost of £15
per hour, minimum £5.
WEB SPACE AND HOSTING
Associate Internet Promotions uses two regular suppliers to host the
web sites it designs(Valiant Internet Services and 1st Choice Web
Hosts). The cost of both hosting and domain registration is included
in any quote given unless requested otherwise. If any other host is
required to be used, they must be able to accommodate FrontPage 2000
server extensions. If this is not the case, AIP will need to
transfer the domain name to its regular supplier. The small cost
involved will be included in any quote.
Associate Internet Promotions will on occasions use other hosting
providers.
PAYMENT
Payment of the set up deposit is required prior to the commencement
of work by Associate Internet Promotions. At the time of the renewal
of the site, payment of the renewal deposit is required before the
server space will be renewed by Associate Internet Promotions. Delay
in making this payment could cause problems ultimately resulting in
the web site being deleted by our suppliers. This is particularly
the case if renewal of the domain name is due as ample processing
time is needed for this to happen.
AIP will not renew any web space or domain name without
payment/written confirmation in the form of an official purchase
order. E-mailed instructions count as an official purchase order.
Spreading the cost of payment across 12 months by use of a standing
order mandate does not constitute an ongoing cost. Full payment for
the whole year is due, even if the web site is discontinued within
that 12 month period. Payment in this way is merely a way of
spreading the total annual cost of the web site. Minimum contract
period is one year.
In case of immediately necessary work, where pre-payment is required
but is not practical, payment should be made within 7 (seven) days
of the receipt of an invoice from Associate Internet Promotions.
In the case of non-payment, interest will be charged at 2% monthly
on all unpaid invoices in excess of six months. AIP reserves the
right to issue a notice of termination to customers in excess of 9
months in arrears. Legal action to recover money owed will also be
considered.
For Basic Web Site customers, full payment is required in advance.
LEGAL ISSUES
Associate Internet Promotions does not warrant that the functions
contained in the Internet website will meet the client's
requirements or that the operation of the web pages will be
uninterrupted or error-free. The entire risk as to the quality and
performance of the web pages and website is with the client.
All customers of AIP automatically accept the terms and conditions
of our regular hosting suppliers Valiant Internet Services and 1st
Choice Web Host. These are available to view at our web site at
www.aip.co.uk.
Associate Internet Promotions does not guarantee a large number of
visitors to its sites and strongly recommends that the client
markets their site around the internet and off line too. AIP will
provide help and advice regarding the best ways to market a business
on the internet as well as search engine promotion and submission
via 1st Choice Promotions.
In no event will Associate Internet Promotions be liable to the
client or any third party for any damages, including any lost
profits, lost savings or other incidental, consequential or special
damages arising out of the operation of or inability to operate
these web pages or website, even if Associate Internet Promotions
has been advised of the possibility of such damages.
COPYRIGHTS AND TRADEMARKS
The client represents to Associate Internet Promotions and
unconditionally guarantees that any elements of text, graphics,
photos, designs, trademarks, or other artwork submitted to Associate
Internet Promotions for inclusion in web pages are owned by the
client, or that the client has permission from the rightful owner to
use each of these elements, and will hold harmless, protect, and
defend Associate Internet Promotions and its subcontractors from any
claim or suit arising from the use of such elements submitted by the
client.
